Fair Use for Rock Star Ate My Hamster

I believe this videogame screenshot should be considered fair-use because:-

1. It is used solely to improve the article's quality.
2. The image used is of my own creation and taken from an emulator and was taken at specific time and date stated above.
3. Since the ZX Spectrum system has now been discontinued, it's highly unlikely that this image would corrupt copyright.
4. To the best of my knowledge it's extremely doubtful that a free-use image of this game even exists.
